Normally, once a temporary contract expires, you are only entitled to payment of the statutory transitional compensation. But did you know that if your contract is not renewed when your employer has behaved not so nicely, you may be entitled to a high severance payment?
Case law example
This played out, for example, with an employee of a playground. She reported unwanted behavior, consisting of sexually oriented WhatsApp messages from one of the board members, including a dick pic. Several months after this, she reported sick. In response, another board member sent her an email stating that her calling in sick would ruin spring break for children. The playground also tried to dismiss the inappropriate WhatsApp messages as an "awkward flirtation attempt."
Normally, at the end of a temporary contract, as said, you are only entitled to the transitional compensation, but the subdistrict court found the directors' behavior seriously culpable and also awarded the employee fair compensation of nearly €10,000, which in this case amounted to six months' salary.
