The facts at Burger King
At Burger King's drive-thru in Aruba, a customer ordered a Whopper with extra pickles. Instead of the requested pickles, however, the customer received bacon on the burger. When she returned the bun and asked for pickles again, things went wrong again. This time, an employee had stuffed dozens of pickles into the burger, far more than usual. The customer took a picture of the bun and posted it with a complaint on Facebook.
Investigation and instant dismissal
Burger King launched an internal investigation into the incident. The employee responsible for the pickle overdose was subsequently fired with immediate effect. The employer felt that she had behaved unprofessionally and had thus damaged the company's image. The question arose whether this dismissal could legally stand.
Judge's verdict
The judge in Aruba, where Dutch labor law applies, ruled that the dismissal was justified. Professionally preparing food for others was seen by the judge as a serious and responsible task. The employee had shown that she was not fit to perform her job in a professional manner. In addition, her action had damaged Burger King's image. The immediate dismissal was therefore upheld. The employee also had to pay the legal costs of 1,800 euros.
Importance of this statement
Although this case seems funny at first glance, the ruling highlights an important employment law principle. Even relatively minor incidents can lead to summary dismissal if there are clear rules of conduct and if the trust between employer and employee has been seriously damaged.
