Introduction

At first glance, time tracking may seem like an administrative formality, but it plays a crucial role in the relationship of trust between employee and employer. Integrity is essential in this regard, especially for employees in managerial positions. In a recent ruling by the Court of Appeal in ’s-Hertogenbosch, a manager in the greenhouse horticulture sector was summarily dismissed for systematic manipulation of his time records. The case illustrates how judges handle workplace fraud and where the boundaries lie for employers and employees.

Time-Sheet Fraud: The Case of the Greenhouse Horticulture Manager

The case revolved around a manager who was responsible for his own time tracking and was authorized to make manual corrections. This aroused suspicion on the part of the employer, who noticed that the manager was correcting his clock-in and clock-out times with remarkable frequency. As a result, the company decided to install three cameras on the work floor to further investigate the employee’s behavior.

The hidden cameras and what they revealed

The cameras, installed in the cafeteria, smoking area, and workspace, revealed that the manager often began his workday by smoking and drinking coffee, even though he had already clocked in. Although he claimed to regularly work overtime, he could not substantiate those extra hours. The footage confirmed that his actual working hours did not match the hours recorded.

Although the use of hidden cameras is a legally sensitive issue, it was permissible in this case due to the suspicion of serious fraud and the employee’s managerial position.

The Court of Appeals’ ruling

The manager argued that it was customary within the company to be flexible about clocking in and out. This would imply that his behavior was, in fact, tolerated. The judge did not accept this argument, because the manager could not substantiate it. According to the employer, they are, in fact, very strict about monitoring hours. Furthermore, as a supervisor, the manager served as a role model and enjoyed the employer’s special trust. By systematically abusing his authority, he had seriously violated that trust.

The court ruled that the summary dismissal was justified. The employee also requested compensation of €100,000 for wrongful termination, but this request was denied. In fact, he was ordered to pay approximately €8,000 in legal costs to his former employer.

Integrity and Exemplary Conduct

This case shows that not only the actual behavior, but also the context in which it occurs, is of great importance. A manager or team leader is expected to set an example. In such roles, missteps carry greater weight, especially when there is deliberate use of authority that others do not have.

In this context, time-sheet fraud is not viewed as an isolated incident, but as a fundamental breach of the employment relationship. This can lead to immediate termination even without a prior warning, with all the consequences that entails—including financial ones.

Conclusion

Falsifying time records is not a harmless mistake, especially when it is done deliberately and repeatedly by someone in a position of trust. Employers are entitled to take strict action against such behavior, and courts have shown that, under the right circumstances, they support such action. This ruling underscores the importance of integrity in the workplace and demonstrates that immediate termination may be justified in cases of serious breach of trust.
