What is a wage claim?
A wage claim is a legal claim by an employee against his employer for payment of back wages(Article 7:625 of the Civil Code). This claim may relate to various wage components, such as arrears, unpaid overtime, unpaid vacation days, incorrect application of the minimum wage, or other outstanding employment benefits to which the employee is legitimately entitled. A wage claim can be filed with the subdistrict court, or the UWV can be applied for benefits when the employer is in default of payment. In this case, the employee may, under conditions, apply for benefits from the UWV based on the wages the employee was still due from the employer.
