What is an ex nunc review?

An ex nunc review is a legal term used to indicate that an assessment is made on the basis of the facts and circumstances at the time of the assessment itself, a mnemonic for this is: 'ex nunc looks at how the situation is now, and ex tunc works from how the situation was then'. In other words, an ex nunc review looks not only at past events or circumstances that may have affected the decision making, but also at how the situation is now.
