What does summary dismissal mean?
Instant dismissal is an immediate termination of the employment contract by the employer for urgent reasons(arts. 7:677 and 7:678 BW). The employer must communicate the urgent reason immediately and clearly to the employee, preferably in writing and preferably on the basis of prior thorough investigation. The law lists a number of non-exhaustive grounds for summary dismissal such as theft or serious misconduct by the employee(Art. 7:678 BW). If the formal requirements for summary dismissal are not met, the employer can be held liable for damages (in the form of liquidated damages and/or fair compensation, among other things).
