When is something an urgent reason for dismissal?
An urgent reason for dismissal, required for a legally valid "summary dismissal," is a serious reason that directly motivates the employer to terminate the employment relationship with the employee immediately without observing the normal notice period(Article 7:677 and 7:678 BW). An urgent reason may include, for example, theft, fraud, assault, refusal to work, or other serious conduct or omissions that make the continuation of the employment relationship immediately impossible. For a legally valid summary dismissal, the circumstances must be so serious that the employer cannot be expected to allow the employment contract to continue any longer. Various procedural requirements also apply.
