Notice requirement

What is the notice requirement?

The obligation to give notice means that the employer must inform the employee in writing at least one month before the end of the temporary employment contract whether or not the employment relationship will continue. The obligation to give notice is included in Section 7:668 of the Civil Code. If the employer fails to fulfill this obligation, this can result in a notice penalty of up to one month's salary. If no notice is given at all, the employer owes the employee a gross monthly salary. If notice is given but not at least one month, but for example three weeks, the employer is one week late. The employer then owes a one-week penalty. The penalty is then calculated 'pro rata'. The employer can also fulfill this obligation by including a notice 'in advance' in the employment contract. This is the case in most employment contracts.
