What is a settlement agreement (VSO)?
In employment law, a settlement agreement is often a termination agreement (Article 7:900 of the Dutch Civil Code). This is a written agreement between an employer and an employee that sets forth the terms and conditions for the termination of employment. Such a settlement agreement includes provisions regarding, among other things, the termination date of the employment relationship, the amount of any severance pay, any exemption from work, the final settlement, references, and any covenants such as a confidentiality clause and a non-compete clause. It is important that a settlement agreement be drafted carefully and that both parties are fully aware of their rights and obligations.
