What does the probationary period entail?

A probationary period is a period at the start of an employment contract during which both the employer and the employee have the option to terminate the employment relationship without further consequences. During the probationary period, both parties can assess whether the position and working conditions meet their expectations and whether there is a good fit between the employer and the employee. The duration of the probationary period is set by law and depends on the duration of the employment contract (Article 7:652 of the Dutch Civil Code). For an employment contract of six months or less, no probationary period may be agreed upon; for a temporary contract of up to two years, the probationary period may not exceed one month; and for a permanent contract, the probationary period may not exceed two months. However, please note: the applicable collective bargaining agreement may deviate from these rules (to the detriment of the employee).
